By accessing or using CallMind AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including business owners, their employees, and any person accessing the platform.

2. Description of Service

CallMind AI provides an AI-powered phone answering and appointment booking service for small businesses. The Service includes:

• AI voice assistant that answers inbound phone calls on your behalf
• Automated appointment scheduling with calendar integration
• SMS and email confirmations to you and your customers
• A web dashboard for managing calls, leads, and appointments
• Integration with third-party services (Twilio, Google Calendar, Stripe)

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate and complete information during registration and keep it up to date.

4. Subscriptions and Billing

Free Trial

New accounts receive a 14-day free trial with full access to their chosen plan's features. No payment is required during the trial period.

Paid Subscriptions

After your trial ends, billing begins automatically if you have provided a payment method. Subscriptions are billed monthly. All fees are in U.S. dollars and are non-refundable except as required by law.

Plan Changes and Cancellation

You may upgrade, downgrade, or cancel your subscription at any time from your dashboard. Cancellations take effect at the end of the current billing period. You will retain access to the Service until that date.

5. Acceptable Use

You agree not to use the Service to:

• Make or receive calls for illegal purposes
• Transmit spam, harassment, or abusive content
• Violate any applicable local, state, national, or international law
• Impersonate another person or business
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to other accounts or systems
• Use the Service to handle Protected Health Information (PHI) without a separate BAA in place

6. AI-Generated Content Disclaimer

CallMind AI uses artificial intelligence to handle phone conversations. While we strive for accuracy, the AI assistant may occasionally misunderstand callers, provide incorrect information, or fail to complete a task as expected. You acknowledge that:

• The AI is not a substitute for human judgment in critical or emergency situations
• CallMind AI is not liable for missed appointments, incorrect bookings, or miscommunications caused by the AI
• You are responsible for reviewing appointments and call logs in your dashboard

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described in that policy. You are responsible for obtaining any necessary consent from your customers before their calls are recorded or transcribed.

8. Third-Party Services

The Service integrates with third-party platforms including Twilio, Google Calendar, Stripe, and SendGrid. Your use of these integrations is subject to the respective third party's terms and privacy policies. CallMind AI is not responsible for the availability, accuracy, or actions of third-party services.

9. Intellectual Property

The Service, including its design, code, AI models, branding, and content, is owned by CallMind AI and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written permission.

10. Limitation of Liability

To the maximum extent permitted by law, CallMind AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, lost business, or data loss, arising from your use of the Service.

Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless CallMind AI, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

12. Service Availability

We aim to maintain high uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

13. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in abusive behavior, or fail to pay subscription fees. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period in accordance with our Privacy Policy.

14. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
